HUBB is the statutory IMHA provider for clients living in Havering, Barking or Dagenham who are subject to, or detained under, the Mental Health Act (1983) and amendments to the Mental Health Act (2007).
Clients may be inpatients at Sunflowers Court (formally Goodmayes Hospital) or under a Community Treatment Order.
Criteria for IMHA Service
In line with the Amendments to the Mental Health Act (2007), from 1st April 2009 clients are eligible for support from an IMHA (Independent Mental Health Advocacy) if they are:
· Detained under the Act (even if they are currently on leave of absence from hospital)
· Conditionally discharged restricted patients
· Subject to guardianship; or Supervised Community Treatment
Other patients may be eligible if they are:
· Being considered for Section 57 treatment
· Under 18 and being considered for ECT or Section 58a treatment
IMHAs can help patients to obtain information about, and to understand:
· their rights under the Act
· the rights which other people(i.e. nearest relatives) have in relation to them under the Act
· any conditions or restrictions patients are subject to
· any medical treatment they may be receiving
IMHAs may also:
· help patients to access a solicitor for Tribunals
· represent patients and speak on their behalf
For these purposes, detention does not include Section 4,
Section 5, Section 135/6 (under a place of safety order)
Early instruction is essential to the successful outcome of advocacy intervention!
